Welcome to OpenMindAgile. These Terms of Use (“Terms”) govern your access to and use of OpenMindAgile’s educational services and website. By enrolling in our programs or using our services, you agree to be bound by these Terms.

Important: Please read these Terms carefully. If you do not agree to these Terms, you may not use our services or enroll in our programs.

1. Acceptance of Terms

By enrolling a child in OpenMindAgile programs or using our services, you confirm that you:

  • Are at least 18 years old or a legal guardian
  • Have the legal authority to enter into binding agreements
  • Agree to comply with all applicable laws and regulations
  • Accept these Terms in their entirety

We use technology tools including Google Sheets integration to:

  • Manage student records efficiently
  • Identify and remove duplicate entries in our databases
  • Synchronize data across our systems
  • Generate progress reports and analytics
  • Maintain accurate educational records

3. Enrollment and Registration

3.1 Registration Requirements

To enroll a child in our programs, parents/guardians must:

  • Provide accurate and complete information
  • Submit required enrollment documentation
  • Agree to program policies and procedures
  • Pay applicable fees on time

3.2 Parental Responsibility

Parents/guardians are responsible for:

  • Ensuring information provided is accurate and up-to-date

  • Complying with attendance and conduct policies

4. Program Participation

4.1 Student Conduct

Students are expected to:

  • Participate respectfully in all activities
  • Follow instructor guidance and program rules
  • Treat other students, staff, and facilities with respect
  • Attend scheduled sessions regularly

4.2 Health and Safety

  • Parents must inform us of any medical conditions, allergies, or special needs
  • We maintain appropriate safety measures during all activities
  • Emergency contact information must be kept current
  • Parents must ensure their child is in appropriate health to participate

5. Fees and Payment

5.1 Program Fees

  • Program fees are communicated during enrollment
  • Fees must be paid according to the agreed schedule
  • Late payments may result in suspension of services
  • We reserve the right to adjust fees with reasonable notice

5.2 Refund Policy

  • Refunds are considered on a case-by-case basis
  • Written refund requests must be submitted to openmindagile@gmail.com
  • Refund eligibility depends on program stage and circumstances
  • Processing fees may apply to approved refunds

6. Privacy and Data Protection

Your use of our services is governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

6.1 Google Services Integration

  • Our administrative staff may use Google Sheets for data management
  • This includes finding duplicate records and maintaining accurate databases
  • Only authorized staff have access to these systems
  • All data handling complies with privacy regulations
Google API Services Compliance: OpenMindAgile’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

6.2 What We Access from Google

When authorized staff members connect their Google accounts to our administrative systems, we may access:

  • Google Sheets: Read, write, and modify spreadsheet data for administrative purposes only
  • Profile Information: Basic profile information (name, email) for authentication
  • Purpose: Finding duplicate records, data synchronization, report generation

6.3 Revoking Google Access

Authorized staff members can revoke OpenMindAgile’s access to their Google account at any time:

  1. Visit your Google Account Permissions
  2. Find OpenMindAgile in the list of connected apps
  3. Click “Remove Access”

7. Intellectual Property

7.1 OpenMindAgile Materials

All educational materials, curricula, resources, and content created by OpenMindAgile are our intellectual property and are protected by copyright laws. These materials may not be:

  • Reproduced or distributed without permission
  • Used for commercial purposes
  • Modified or adapted without authorization
  • Shared with non-enrolled parties

7.2 Student Work

Students retain ownership of their original creative work produced during programs, while OpenMindAgile may use such work for:

  • Educational purposes within our programs
  • Marketing and promotional materials (with parental consent)
  • Program improvement and assessment

8. Photography and Media

8.1 Consent

During enrollment, we request consent to photograph or video students for:

  • Documentation of educational activities
  • Marketing and promotional materials
  • Website and social media content
  • Internal training and improvement purposes

8.2 Opt-Out

Parents may opt out of photography/media consent at any time by notifying us in writing. We will make reasonable efforts to exclude opted-out students from media capture.

9. Program Modifications and Cancellations

9.1 Our Right to Modify

We reserve the right to:

  • Modify program schedules, content, or structure with reasonable notice
  • Substitute instructors when necessary
  • Cancel or postpone sessions due to circumstances beyond our control
  • Change policies and procedures with appropriate notification

9.2 Program Cancellations

If we cancel a program:

  • Enrolled families will be notified as soon as possible
  • Refunds or credits will be provided for cancelled sessions
  • We will make reasonable efforts to reschedule when possible

10. Termination

10.1 Termination by Parents

Parents may withdraw their child from programs by:

  • Providing written notice to openmindagile@gmail.com
  • Settling any outstanding fees
  • Returning any borrowed materials or equipment

10.2 Termination by OpenMindAgile

We may terminate enrollment immediately if:

  • Program fees remain unpaid despite reminders
  • Student conduct violates our policies repeatedly
  • False information was provided during enrollment
  • Parents/guardians violate these Terms
  • Continuing enrollment poses safety or operational risks

11. Liability and Disclaimers

11.1 Educational Outcomes

While we strive for excellence in education:

  • We do not guarantee specific educational outcomes or results
  • Individual student progress varies based on many factors
  • Parents share responsibility for supporting learning
  • Success depends on student effort, attendance, and engagement

11.2 Limitation of Liability

To the maximum extent permitted by law:

  • OpenMindAgile is not liable for indirect, incidental, or consequential damages
  • Our total liability for any claim shall not exceed fees paid in the preceding 12 months
  • We are not responsible for outcomes beyond our reasonable control

11.3 Personal Property

  • OpenMindAgile is not responsible for lost, stolen, or damaged personal property
  • Parents should ensure valuable items are not brought to programs
  • Students are responsible for their belongings

12. Indemnification

Parents/guardians agree to indemnify and hold harmless OpenMindAgile, its staff, and instructors from any claims, damages, or expenses arising from:

  • Their child’s conduct during programs
  • Breach of these Terms
  • Provision of inaccurate or false information
  • Violation of another party’s rights

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.

13.2 Informal Resolution

Before pursuing formal action, parties agree to attempt good-faith negotiation to resolve disputes by contacting openmindagile@gmail.com.

13.3 Jurisdiction

Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Shah Alam, Selangor, Malaysia.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and enrollment documentation, constitute the entire agreement between parents/guardians and OpenMindAgile.

14.2 Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via:

  • Email notification to enrolled families
  • Updates posted on our website
  • Notice provided at program sessions

Continued participation after changes constitutes acceptance of revised Terms.

14.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.

14.4 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including:

  • Natural disasters or severe weather
  • Public health emergencies or pandemics
  • Government actions or regulations
  • Facility closures or unavailability
